Chapter 28

א לא סתמן צריכא למימר דמזבנינן ולא פירושן צריכא למימר דלא מזבנינן אלא סתמן דקאמר חיטי פירושן דקאמר חוורתא
1 In that case it is neither necessary to state that the unspecified may be sold, nor is it necessary to state that the specified may not be sold. Rather, “unspecified” means if he asks for wheat and “specified” when he asks for white wheat.
ב מכלל דתרנגול אפי' סתמן נמי לא אמרי לעולם סתמן דקאמר חיטי חוורתא פירושן דקאמר לעבודת כוכבים
2 This implies that in the case of a rooster it is forbidden even when unspecified! We may indeed say that “unspecified” is when he asks for white wheat, and “specified” is when he states [that it is required] for idolatry;
ג ופירושן אצטריכא ליה סד"א האי גברא לאו לעבודת כוכבים קא בעי אלא מיבק הוא דאביק בעבודת כוכבים וסבר כי היכי דההוא גברא אביק ביה כ"ע נמי אביקו אימא הכי כי היכי דליתבו לי קמ"ל
3 yet it is necessary to state that the “specified” is forbidden lest I say that that man does not really require it for idolatry. Rather, he is attached to idolatry, and he thinks to himself that just I am attached to it everyone is attached to it, and therefore I will say this so that they might readily give it to me. It is therefore necessary to state [that its sale is forbidden].
ד בעי רב אשי תרנגול לבן קטוע למי מהו למכור לו תרנגול לבן שלם מי אמרינן מדקאמר קטוע לאו לעבודת כוכבים קבעי או דלמא איערומי קא מערים
4 Ashi asked: [If he asks,] “Who has a mutilated white rooster?” may one sell him an unblemished white rooster? Do we say that since he asks for a mutilated one, he is not asking for it for idolatry, or perhaps he is merely acting cunningly?
ה את"ל האי איערומי הוא דקא מערים תרנגול לבן למי תרנגול לבן למי ויהבו ליה שחור ושקל ויהבו ליה אדום ושקל מהו למכור לו לבן מי אמרינן כיון דיהבו שחור ושקל אדום ושקל לאו לעבודת כוכבים קא בעי או דלמא איערומי קא מערים תיקו:
5 And if you should say that this one is acting cunningly, [what about the following,] “Who has a white rooster? Who has a white rooster?” and when a black one is given to him he accepts it or when a red one is given to him he accepts it, may a white one be sold to him? Do we say, since when he was given a black one or a red one he accepted it, he is not asking for one for idolatry, or perhaps he is merely acting cunningly? This stands undecided.
ו ר"מ אומר אף דקל וכו': א"ל רב חסדא לאבימי גמירי דעבודת כוכבים דאברהם אבינו ד' מאה פירקי הויין ואנן חמשה תנן ולא ידעינן מאי קאמרינן
6 Meir says: Also a good palm etc. R. Hisda to Abimi: There is a tradition that the [tractate] Avodah Zarah of our Abraham our father consisted of four hundred chapters; we have only learnt five, yet we do not know what we are saying.
ז ומאי קשיא דקתני ר"מ אומר אף דקל טב חצב ונקלס אסור למכור לעובדי כוכבים דקל טב הוא דלא מזבנינן הא דקל ביש מזבנינן והתנן אין מוכרין להם במחובר לקרקע א"ל מאי דקל טב פירות דקל טב וכן אמר רב הונא פירות דקל טב
7 And what difficulty is there? It is taught: R. Meir says: also a good palm, hatzav and niklas are forbidden to be sold to idolaters– a “good palm” may not be sold to them, but we may sell them a bad palm. But have we not taught: One may not sell them anything that is attached to the ground! He replied: What is meant by “good-palm”? Fruit of a “good-palm.” And so too said R. Huna: The fruit of a good-palm.
ח חצב קשבא נקלס כי אתא רב דימי א"ר חמא בר יוסף קורייטי א"ל אביי לרב דימי תנן נקלס ולא ידעינן מהו ואת אמרת קורייטי ולא ידעינן מאי אהנית לן א"ל אהנאי לכו דכי אזלת התם אמרת להו נקלס ולא ידעי אמרת להו קורייטי וידעי וקא מחוו לך:
8 Hatzav is the species of dates called kashba. Niklas: When R. Dimi came he said in the name of R. Hama b. Joseph that it is kuryati. Abaye said to R. Dimi: We taught niklas, and do not know what it is, so you tell us it is kuryati which we do not know either, where then have you benefited us? He said: I have provided you with benefit for were you to go to there (to Eretz Yisrael) and say niklas they would know what it is; but if you say kuryati they will know and will show it to you.
ט <big><strong>מתני׳</strong></big> מקום שנהגו למכור בהמה דקה לעובדי כוכבים מוכרין מקום שנהגו שלא למכור אין מוכרין ובכל מקום אין מוכרין להם בהמה גסה עגלים וסייחים שלמין ושבורין ר' יהודה מתיר בשבורה ובן בתירא מתיר בסוס:
9 In a place where it is the custom to sell small domesticated animals to non-Jews, such a sale is permitted; but where the custom is not to sell, such a sale is not permitted. In no place however is it permitted to sell large animals, calves or foals, whether whole or maimed. Rabbi Judah permits in the case of a maimed one. And Ben Bateira permits in the case of a horse.
י <big><strong>גמ׳</strong></big> למימרא דאיסורא ליכא מנהגא הוא דאיכא היכא דנהיג איסור נהוג היכא דנהיג היתר נהוג
10 GEMARA. This is to say that there is no actual prohibition, but that it is only a matter of custom; so that where the custom is to prohibit, it is to be followed, and where the custom is to permit it is to be followed?
יא ורמינהי אין מעמידין בהמה בפונדקאות של עובדי כוכבים מפני שחשודין על הרביעה אמר רב מקום שהתירו למכור התירו לייחד מקום שאסרו לייחד אסרו למכור
11 But this contradicts the following [Mishnah]: One should not place cattle in inns kept by idolaters, because they are suspected of bestiality! Rav said: In places where it is permitted to sell, it is permitted to leave them together alone, but in places where leaving them together alone is forbidden, it is also forbidden to sell.
